AUCTION POLICIES



Auction Begins:

The auction will have already began when you receive the auction catalog or logon to the website.

Business Hours:
Monday through Friday from 9:00 am to 5:00 pm mountain time (sometime the office closes early on Fridays). WE ARE CLOSED ON WEEKENDS. The closing day of a featured catalog auction, the office will be open the entire day until the last item closes, as dictated by the Ten Minute Rule.

Ten Minute Rule:
The final day of bidding in our weekly auctions or featured auctions (TBA) a Ten Minute Rule will apply. Once you have entered a bid on a desired lot prior to the auction closing at 10:00 pm est the lot can be bid on within a Ten Minute window. If you have not bid on a lot before 10:00 pm est, you will not be able to bid after 10:00 pm est. If you are the only bidder on a lot at closing then you are the winner of that lot. Bidding will continue on all remaining lots until 10 minutes have passed without any bidding activity on each prospective lot. East Coast Sports Auctions reserves the right to close the auction at its sole discretion and time.

Registration:
If you are already registered on our website at www.eastcoastsportsauctions.com then simply logon and click the Auction link. If you are a new customer to our website go to eastcoastsportsauctions.com and complete the registration process on our website then your information will be emailed to you and then you can logon and bid in all of our auctions. If you don’t have access to the internet, you can contact our office during normal business hours and we can assist you in the registration process. You need to contact us by telephone for update on your lots East Coast Sports Auctions reserves the right to refuse any bidder or accept bids from anyone at its own discretion. Once you have registered your bidding information it will remain the same for all future auctions.

Bidding:
All lots will have a minimum bid and nothing will be accepted below the stated minimum bid. All bidding will increase in whole dollar bidding depending on the amount of the lot. You can review or raise your bids as often as you wish as dictated by the Ten Minute Rule which goes into effect at 10:00 pm est on the closing day of the auction. You may enter a bid limit on each item in our auction East Coast Sports Auctions will offer call backs to those bidders that have ceiling bids on items closing the night of the auction. We will contact you the night of the auction if your maximum bid has been topped by another bidder prior to closing. You must contact us prior to closing in order for us to raise your minimum bid. We must have your correct telephone number(s) where you can be reached the night of the auction. This service must be requested and we cannot guarantee the reliability of such service depending on the number of requests. You're safest bet is to bid online.

Withdrawing Bid(s):
Once a bid is placed by any bidder, you are obligated to honor that bid(s). In other words, no bids may be withdrawn at any time once a bid has been placed. There will be no exceptions to this rule and failure to comply with these guidelines will be termination from all future bidding with Todd Mueller Autographs, Inc. or East Coast Sports Auctions

Placing a Bid:
By placing a bid or otherwise participating in our auctions, you are accepting all of the terms and conditions stated herein and in other policies set in place by East Coast Sports Auctions that are otherwise outline on our website and site policies contained therein. By placing a bid in our auction(s) you are agreeing to the alternative dispute of arbitration. Arbitration replaces your right to go to court, including the right of trial by jury. If a dispute surfaces regarding payment, authenticity, grading, description, provenance, shipping or any other matter pertaining to the auction(s) auction(s) and/or East Coast Sports Auctions, you agree that the dispute shall go before a binding arbitration as set forth in accordance with the commercial rules of the American Arbitration Association or A.A.A and any and all Arbitration will take place in Broward County Florida. Any and all claims made six months after the close of a transaction will be barred.

Winner Notification:
Winner notification will be made by email within 24 hours of closing an auction. If you are bidding via telephone, then we will notify you either by telephone, fax or US mail.

Payment:
We accept Visa, Master Card, PayPal, check or money order. All payments must be made within 14 days of the closing date of an auction, otherwise, East Coast Sports Auctions reserves the right to refuse payment after 14 days. Any unclaimed lots will be offered to the next highest bidder. Failure to honor these terms and conditions will mean termination of all future bidding privileges in our auctions. If an account is re-instated after termination, a $100 re-instatement fee will be processed and the credit card on file will be automatically charged for each auction the Monday after the auction closes.

Shipping Guidelines:
Once payment has been received and processed US orders will be shipped two day priority mail with the US Postal Services. International shipments will be shipped first class mail with the US Postal Service. We reserve the right to determine the cost of shipping based on the weight, size and destination of your order. To review our shipping guidelines in detail visit our shipping policy on the website. All framed pieces will be shipped and sold "As Is" and marked "Final". East Coast Sports Auctions is not responsible for items damaged during shipping. We do not remove any items from the frames. Condition refers only to the item and not the matte or frame. Terms of return apply only to the item and not the matting and/or framing. Any item removed from the matte and/or frame cannot be returned.

Buyer’s Premium:
East Coast Sports Auctions charges a 5% buyers premium for all their auctions.

Returns:
All items have been described with the intent of accuracy. We do not accept returns for any reason.

Guarantees:
Each autographed/signed item is sold as genuine for those items already authenticated by a third party authenticator. If you do not like the person who has authenticated a specific item or lot, don’t bid on it. If there is a dispute as to the authentication of an item, the dispute will be between the buyer and the authenticator. Buyer agrees that East Coast Sports Auctions is merely a platform for selling these items and makes no warranties as to their authenticity. This guarantee does not apply to non-autographed items.

Legal Disputes:
If you have any type of dispute with East Coast Sports Auctions , then all legal action will go before the American Arbitration Association or A.A.A. and will take place in Broward County Florida. By bidding in our auction(s) you are foregoing the right to trial by jury in any and all legal disputes. It is agreed that the loser of any action agrees to pay the others legal and filing fees.

Postponement of an Auction:
We reserve the right to postpone an auction for a period of time as a result of an Act of God, etc.

By using the East Coast Sports Auctions auction system, you agree to comply with any and all Auction Guidelines and any and all state, federal or international laws that apply. In addition, you agree to use the system at your own risk and pursuant to the following terms: eastcoastsportsauctions.com reserves the right to refuse use of the auction system/service to anyone at any time for any reason or no reason at our sole discretion.

East Coast Sports Auctions shall be held harmless by any user who may experience problems, loss or damage arising or originating from use of the system/service.

East Coast Sports Auctions is not responsible for any problems, damage or loss caused by circumstances out of our control. This includes but is not limited to system failures, system errors, Internet related problems, power outages, fire and theft.

East Coast Sports Auctions reserves the right to omit, remove, or re-categorize, at any time, any listing at our sole discretion.

East Coast Sports Auctions does not guarantee the receipt of e-mail associated with invoicing, bidding updates and winning bid notices by any user of the auction system.

East Coast Sports Auctions strictly prohibits any inappropriate use of the system. However, auction. East Coast Sports Auctions cannot and does not guarantee that inappropriate use of the system will be prevented or noticed.

EastCoastSportsAuctions.com requires users to be of legal age in any and all jurisdiction that may apply to any transaction.

EastCoastSportsAuctions.com strictly prohibits users from sending unsolicited e-mail to other users (i.e no spamming.) The following information details our Privacy Policy. Any changes to this policy will be posted on this page.

Information That We Collect:
When you register we require your e-mail address, first and last name, street address, city, state, country, zip code, home phone, and password selection in additon to other optional information. We may also collect information on the type of browser you are using, your IP address and the URL you came from and go to upon leaving our site.

Your Password:

When you register, you may be placed on our "opt-in" mailing list by default unless you explicitly selected "NO" when you registered. We will occasionally send you information on the site to keep you informed of new services, changes to the User Agreement and/or any other events we deem important for our users to know about. You may always "unsubscribe" from our list at any time.

Disclosure of Your Information:
We do not sell or rent your personal information to third parties. Your information is only provided to the administrators of the sites upon which you are bidding.

We may opt to use WebTrends Live to analyze traffic to this web site. WebTrends Live does not create individual profiles for visitors. SHIPPING WITHIN THE UNITED STATES:
Priority Mail with the USPS at a rate of $6.95. This applies for flat item(s) under 16oz. For other items that are over-sized, such as tubes, framed pieces or packages over 16oz we will ship Priority Mail with the USPS at a rate given by USPS for the package weight and size. If you request insurance on your order, the actual fee charged by the USPS will be applied to your order. ITEMS DAMAGED IN TRANSIT ARE NOT OUR RESPONSIBILITY. We encourage you to purchase insurance for all your high dollar value items. SHIPPING OUTSIDE THE UNITED STATES:
First Class International mail with the USPS. For all flats, packages, such as tubes, framed pieces, etc. the rate will be determined by the size and weight of the package. If you request insurance on your order, you will be charged the cost of the insurance issued by USPS. In many cases, insured international packages must be shipped via Express Mail with a minimum charge of $30 for insured packages. ITEMS DAMAGED IN TRANSIT ARE NOT OUR RESPONSIBILITY. We encourage you to purchase insurance for all your high dollar value items.

USER AGREEMENT:


Thank you for selecting East Coast Sports Auctions for your merchandising needs. The following User Agreement (the "User Agreement") contains the terms and conditions for the use of our auction system. By submitting your registration, you agree to the terms and conditions contained below in this User Agreement. The U

ser Agreement may be updated byEast Coast Sports Auctions at any time. The amended User Agreement will be posted on the site and must be accepted by any and all participants of the system and its services. Acceptance of the User Agreement requires you to abide by the Guidelines (the "Guidelines"), which explain the site rules, as well as acceptable and unacceptable conduct by users. If you do not accept the User Agreement, you are prohibited from using theEast Coast Sports Auctions auction service.

Eligibility & Registration
The use of theEast Coast Sports Auctions auction system and services is limited to parties who can enter into and form legally binding contracts under applicable law. Minors (those under 18) are prohibited from using the system and services. Users must provide truthful and accurate information when registering, as registration indicates acceptance of this User Agreement. EastCoastSportsAuctions.com reserves the right to refuse use of the system and services to anyone at any time for any reason without notice.

Use of the Services and Site

Prohibited Use:

Bidding & Buying
Bidders must honor all successful bids placed in any auction, and are obligated to complete the transaction with East Coast Sports Auctions or the respective seller. The winning bid is defined as the high bid in a regular auction (one with no reserve price) or the high bid in a reserve auction that meets or exceeds the reserve price. By bidding in the auction the Buyer agrees to honor all listed terms of sale including, but not limited to, method of payment, appropriate state sales tax, and shipping and handling fees. Failure to honor this obligation may result in the termination of the Buyer's registration and litigation by us.

Bid Retraction:
Bids are not retractable except under circumstances deemed appropriate by East Coast Sports Auctions Possible examples include instances whenEast Coast Sports Auctions makes material changes to the description of an item, or when blatant typographical errors are present.

Bid Manipulation:
Bid manipulation in any form, and for any reason is strictly prohibited!

System Integrity
Undermining the usability or working condition of any East Coast Sports Auctions site or web server is strictly prohibited. Unauthorized use of passwords or user accounts is also prohibited. Do not share your account information with other parties.

Breach of the User Agreement
Breach of this User Agreement may result in termination or temporary suspension of yourEast Coast Sports Auctions account. Providing inaccurate registration information constitutes breach of this agreement.

No Warranties
East Coast Sports Auctions website is provided "as is". East Coast Sports Auctions makes no warranties or representations of any kind, expressed or implied. East Coast Sports Auctions does not guarantee the availability of any of its services.

Limitation of Liability
East Coast Sports Auctions shall in no event be held liable for any damages arising out of use (or inability to use) of the site and services, or in connection with this User Agreement.

Acceptance of this User Agreement and participation in our services requires your acceptance to and agreement to abide by our Legal Disclaimer.

General Release
Buyers and Sellers agree to release East Coast Sports Auctions and its employees and agents should a dispute arise between the parties during a transaction. Each party agrees to release East Coast Sports Auctions from claims, demands, damages (actual and consequential) of every kind and nature, known and unknown, suspected and unsuspected, disclosed and undisclosed, arising out of or in any way associated with such disputes.

Legal Compliance
Users are required to comply with all local, state and federal laws regarding use of our services.

Copyright
The content of East Coast Sports Auctions owned and operated web sites is the property of East Coast Sports Auctions or the suppliers of the content and is protected by US and International copyright laws. All software used to run the site is the sole property of Blue Dogg, Inc. (dba simpleauctionssite.com.) and may not be used by any other party in any way, shape or form.

Non-Payment
If a buyer doesn't submit payment within 5 days of an auction closing, East Coast Sports Auctions reserves the right to refuse payment after the 5 day period of an auction closing. Buyers have 5 days from the receipt of invoice to submit payment to East Coast Sports Auctions The item can be relisted at our discretion orEast Coast Sports Auctions may choose to litigate.
